What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). For website operators and service providers, the DMCA provides a “safe harbor” from liability for copyright infringement by users, provided the operator follows specific procedures for handling takedown notices and counter-notices.

How to File a DMCA Takedown Notice

If you are a copyright owner or authorized agent and believe that content on Delta Executor infringes your copyright, you may submit a DMCA takedown notice. To be valid under 17 U.S.C. § 512(c)(3), your notice must include the following information:

Counter-Notice Procedure

If you believe that content was removed from Delta Executor due to a mistake or misidentification, you may submit a counter-notice. To be valid under 17 U.S.C. § 512(g)(3), your counter-notice must include:

  • Physical or electronic signature of the subscriber (user who posted the content)
  • Identification of the removed material and its location before removal (specific URLs)
  • Statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  • Your name, address, telephone number, and email address
  • Statement consenting to jurisdiction of the Federal District Court for your judicial district (or if outside the US, any judicial district where Delta Executor may be found)
  • Statement accepting service of process from the person who filed the original notice or their agent

Important: Submitting a false counter-notice may result in liability for damages under Section 512(f) of the DMCA. If you are uncertain about your rights, please consult an attorney before submitting a counter-notice.

Our Response Process

Upon receipt of a valid DMCA takedown notice, Delta Executor will:

  1. Review the notice for completeness and validity under DMCA requirements
  2. Remove or disable access to the allegedly infringing material promptly
  3. Notify the affected user that their content has been removed and provide information about the counter-notice process
  4. Forward the notice to the user who posted the content (if identifiable)
  5. Restore content if a valid counter-notice is received and the copyright owner does not file a lawsuit within 10-14 business days

We aim to process valid DMCA notices within 24-48 business hours of receipt. Complex cases may require additional time for legal review.

Repeat Infringer Policy

Delta Executor maintains a policy of terminating access to our Services for users who are determined to be repeat infringers of copyright or other intellectual property rights.

What constitutes a “repeat infringer”:

  • A user who has received multiple valid DMCA takedown notices
  • A user who has submitted multiple invalid counter-notices
  • A user who has been found liable for copyright infringement in a court of law

Each case is evaluated individually, considering factors such as the nature of the infringement, the user’s history, and whether the infringement was willful or inadvertent. Users terminated under this policy may appeal the decision by contacting us with additional information.

International Copyright Considerations

While Delta Executor is based in the United States and complies with U.S. copyright law, we recognize that copyright protection varies by jurisdiction. Our DMCA policy is designed to accommodate international rights holders while maintaining compliance with applicable laws.

For non-U.S. copyright holders:

  • DMCA notices from international rights holders are accepted and processed
